Pick-up at branch

• Upon collection, please present a valid ordering number and the confirmation letter.
• If customer cannot pick-up the food at the date and time specified on notification email, the order will be forfeited and there will be no refund.

Payment Details

• The total payment for the online ordering service, or the balance of the payment after discounts or discounts (if applicable) must be paid online by credit card (VISA or Mastercard, except UnionPay and American Express Cards), Apple Pay, Google Pay, Octopus, Alipay HK, Alipay CN, Wechat Pay HK or Wechat Pay CN.
• The company reserves the right to change the payment method from time to time without prior notice.

General

For the purposes of this section, “Café de Coral Fast Food Limited” means Café de Coral Fast Food Limited and/or its associated companies or subsidiaries, hereinafter referred as the “Company”.

Terms and Conditions

1. Your use of the eatcdc.com (“this Page”) means that you have accepted these Terms and Conditions (i.e. the Online Ordering Terms, the Terms of Use and Conditions and the Personal Information Collection Statement (collectively referred as “Terms and Conditions”). All information released and received via this page shall be subjected to the regulation of these Terms and Conditions.
2. The Company technically operates this page. However, we exercise no editorial control over some of the content on the page particularly when the contents or other Internet sites are provided by other persons on the Page or are partly operated by other persons you may view or access through the Page (“Third Party Providers”).
3. We reserve the right to modify the terms and conditions from time to time by updating this posting. The revised terms will take effect when they are posted.
4. You acknowledge that we may, in our sole discretion and with or without notice,
   1. vary the Page or any part of the Page (including any Sub Portal for which you are required to register); and
   2. modify or discontinue this page, any part of the Page and the services available on it without notice.

In the event of any compensation claim, program, damage compensation, injury, debt, loss, costs and expenditure (including reasonable legal costs and expenditure) arising from your breach of these Terms and Conditions or illegal behavior, you agree to compensate the Company and its affiliates, related companies, associated companies, employees, agents and representatives, defend them and prevent them from loss.

(I) Online Ordering Terms

1. You agree to comply with all applicable laws and regulations, and be solely responsible for your conduct or negligence (including the content/data transferred via the online ordering service).
2. When you use this page, you agree you will disclaim our Company from any liabilities due to direct, indirect, or sudden loss (including loss or damage of data) caused by your use of this page, or relevant links or content accessible via this page).
3. You agree not to (including but not limited to):
   • interfere with the use and enjoyment of the online ordering service of other user(s).
   • adopt any unlawful manner or any other possible method(s) that may undermine, disable, overload, damage this page or the online ordering service.
   • access to the online ordering service without authorization or other accounts, computer systems or networks connected to the online ordering service.

   • transmit, email, or post any information or program that contains software viruses, in order to interrupt, destroy or limit the functionality of this page or any computer software or hardware or telecommunications equipment.

(II) Terms of Use and Conditions

1. Eligibility

   You must be aged eighteen (18) years or older to use online ordering service. If you are below 18 years old, or you are not legally capable, you should seek advice from your parents or guardians as to the content of these Terms and Conditions before using our online ordering service. By using online ordering service, you represent and warrant that you are aged 18 years old or above and that you understand, agree to and comply with these Terms and Conditions.

2. Online Ordering

   You shall be legally liable for your conduct performed, including but not limited to, ordering goods or services from our Company. You agree to indemnify our Company for any claims made against our Company caused by any third party (including unauthorized use of the credit card number) . Our Company reserves the right to reject any online order if such online order is believed to be fake or made by fault after reviewing the online order history or the payment details.

3. Product Information
   1. Our Company shall exercise its best endeavours to ensure that the product prices, details and sizes of the products contained in this page is correct but our Company reserves the right to vary the price and other product details without prior notice. Although our Company exercises its best endeavours to satisfy the special dietary requirements of its customers, our Company cannot guarantee that it can meet such requirements of every customer.

4. Information about Ordering the Meals

   Our Company shall use its best endeavours to complete the online orders submitted through the Page, but our Company disclaims liability if our Company declines any online order due to unforeseeable change on the products, or shortage of any product or ingredient and hence our Company cannot complete the online order, or any other reason. Our Company only provides online ordering service at designated shops stipulated in this page and our Company shall modify the list of shops from time to time without prior notice. The available shops and online ordering service time are according to information shown in the Page.

5. Details on Collecting the Meals

   1. Once you have confirmed your order and settled payment successfully via the Page, the transaction will be completed, and our Company shall not refund payment paid in any event unless there is fault made by our Company. The food will be prepared upon payment is completed to ensure the food is kept fresh. The patience of customers is highly appreciated.

      Please go to the selected pick-up branch to confirm your order and complete payment within assigned period. Otherwise, the submitted order will be cancelled without further notification.

   2. This page provides self-pickup ordering services or delivery services.
   3. All prices are listed in Hong Kong Dollars.
   4. The prices posted on this page are for online ordering only. Prices for some products may differ from those charged at the Company store(s).
   5. Once an order is confirmed and the payment is settled, neither the order can be cancelled nor the item(s) of the order can be changed.
   6. Please go to your selected branch to pick up your ordered products after your payment. If an ordered product is not picked up within 30 minutes from your payment time, the order will be deemed forfeited and no refund will be made. Notwithstanding the foregoing, the 30-minute limit will be shortened depending on the opening hours of the relevant branch.
   7. During pick-up, you must show the valid order confirmation to the branch’s staff for verification. Each order confirmation can be used for pick-up once only. Pick-up records held by the Company shall be treated as the conclusive evidence and you agree not to raise any object thereto.
   8. It is your duty to keep the order confirmation at a secured place. Anyone who picks up the order with a valid order confirmation will be deemed your authorized representative.
6. Payment Terms
   1. Payment for online ordering must be settled by a valid credit card (VISA or MASTERCARD), Apple Pay, Alipay HK, Alipay CN, Wechat Pay HK or Wechat Pay CN.
   2. . The Company reserves the right to change the payment method for any order without prior notice. Our Company shall exercise its best endeavours to ensure the prices of the products are accurate. Please contact our staff at the shops or contact us [email protected] in case there is any problem.

(III) Personal Privacy Policy and Personal Data Collection

Our Privacy Policy will apply to any personal information, including but not limited to, your email address, your credit card information, which are voluntarily submitted by you when ordering from us through this page. Such personal information collected from you will be used for processing and following up your orders and payments and for other directly related purposes.

Where payment is made for the online ordering via this page, you acknowledge, agree and consent that your personal information such as credit card information may be collected by third parties (located within and outside Hong Kong) processing transactions, including debit/ credit card companies, banks and payment gateways, and, subject to their respective personal data privacy policies and applicable laws, may be used, processed and stored by such third parties to facilitate payments that you now or subsequently make for orders placed.

1. Copyright
   1. You acknowledge that the content on the Page is subject to copyright and possibly other intellectual property rights (“Intellectual Property Rights”). Unless you are expressed authorized by law, you must not by yourself or permit any other person to:
      1. Our Company shall use our best endeavours to ensure that your order is correctly and satisfactorily fulfilled according to the online ordering service.

In no event shall our Company be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature or causes beyond its reasonable control including, without limitation, internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, shortages of labour or materials, fires, floods,storms, explosions, acts of God or delays or non-performance by third parties.
5. Our Company does not authorize any agent or representative to make any warranties, representations or statements regarding the products or the online ordering service and our Company shall not in any way be bound by any such unauthorised warranties, representations or statements.
6. To the extent permitted by law, our Company shall not be liable for any direct, indirect, special, incidental, or consequential damages (including damages for loss of revenue, profits or data arising from the contract issue, infringement issue or other matters (including negligence)) caused by using or inability to use this page (including online payment service), including:

   (i) incorrect or inaccurate content of this page;

   (ii) personal injuries or property damage of any kind (including damage to online device) caused by using or accessing to this page or online ordering service;

   (iii) any unauthorized use or access to this page, online ordering service and/or loss of personal data therein;

   (iv) any interruption or transmission suspension of this page or online ordering service; or

   (v) errors, viruses or any similar matters that are transferred via this page or online ordering service.

7. In case of mechanical failure or deliberate damage against the website causing inaccurate pricing of the products, our Company reserves the rights to make final decision.

(VI) Miscellaneous

1. These Terms and Conditions will be governed by and construed in accordance with the laws of Hong Kong, and the parties agree to submit to the exclusive jurisdiction of the courts of Hong Kong. If for any reason a court finds any provision or portion of these Terms and Conditions to be unenforceable, the remainder of these Terms and Conditions will continue in full force and effect. Any waiver of any provision of these Terms and Conditions by a party will be effective only if in writing and signed.
2. These Terms and Conditions shall survive after you have terminated your use of the online ordering service.
3. In case of disputes on these Terms and Conditions, our Company’s decision shall be final.
4. These Terms and Conditions are written in Chinese and English. In case of discrepancies between the Chinese and English versions, the English version shall prevail.
5. Save for the Company’s affiliates, no third party has any right under the Contracts (Rights of Third Parties) Ordinance to enforce any rights and/ or benefits hereof. Notwithstanding the above, the consent of any third party is not required to rescind or vary the Terms and Conditions.
